EME Funds

The Emergency Medical Exam (EME) Funds are the funds of last resort for sexual assault victims whose claim for payment of rape exam costs has been denied by local law enforcement or victim compensation boards. Though the law enforcement agency that requests forensic evidence collection is legally required to pay these costs (C.R.S. 18-3-407.5(1)), sometimes barriers exist.

With the current VAWA 2005 Updates, these funds are no longer issued by CCASA. The  VAWA Updates state that victims of sexual assault can receive a forensic evidence collection kit, paid for and stored by law enforcement. Victims must present to a medical facility, request the kit and sign the necessary forms for law enforcement. The kit will be stored for at least 30 days, possibly more depending on the jurisdiction. During this time, the victim will decide whether or not to work with law enforcement to file a report and move forward with the case. The vicitm can chose not to pursue, and the evidence will be discarded. This change was made to allow victims the time to consider their options and not be forced to make a decision right after their attack.
